It’s important to remember, however, that you have the right to fight your charges in court. With the help of an experienced defense attorney, in some cases you can even get your charges dismissed.

If you don’t get your charges dismissed, the conviction can stay on your record for life. Even a misdemeanor criminal charge can make it harder for you to obtain a job or seek housing in the future in Oklahoma City. Common Types of Drug Crimes

At Talley, Turner, Stice & Bertman, our drug defense attorneys represent clients facing prosecution for drug offenses under Oklahoma law, such as:

Simple Possession – A person may face prosecution for simple possession of controlled substances if they possess drugs for personal consumption, as opposed to drugs they intend to sell, distribute, or deliver to other people. Under Oklahoma state law, simple possession of most types of controlled substances constitutes a misdemeanor offense. However, multiple convictions for simple possession can result in the grading of an offense as a felony charge.
Possession with Intent to Distribute – A person commits a crime of possession with intent to distribute if they possess drugs they intend to sell, distribute, or deliver to other people. Juries may infer intent to distribute from various circumstances, such as the quantity of drugs possessed, the packaging of the drugs (packaged for transportation or individual sale), the possession of drug packaging equipment or materials, and the possession of large quantities of cash in proximity to the drugs.
Drug Trafficking – A person commits drug trafficking if they knowingly distribute, manufacture, bring into this state, or possess illegal drugs of a certain quantity, the amount is determined by statute and that amount varies dependent on the specific substance. Contrary to popular belief a person does not have to be transporting the drugs or actively selling them to be charged with drug trafficking. If the amount of substance is above a certain threshold, the charge will be elevated to aggravated drug trafficking. The range of punishments for trafficking can be fines up to $500,000.00 and life in prison. Drug trafficking can also lead to federal criminal charges when a person transports drugs from one state to another or transports illicit drugs into the U.S. from another country.
Drug Manufacturing – A person may face criminal prosecution for manufacturing or cultivating controlled substances without authorization.
Possession of Drug Paraphernalia – A person may commit a crime if they possess equipment, materials, or products used or intended for use in activities related to controlled dangerous substances, including cultivation, manufacturing, packaging, and consumption. Offenses usually result in misdemeanor charges with penalties that increase for repeat offenses.

How A Drug Conviction Can Affect Your Life

It’s no secret that a drug conviction can negatively affect your life in a variety of ways, but you may not realize that even a misdemeanor charge, which you may think is minor, can leave a lasting mark on your record and your reputation. This charge will show up on your permanent record every time a background check is run on you, and assumptions can easily be made.

You may think it’s a hassle to hire a criminal defense lawyer to fight a drug charge, but it can keep you from being seen as a delinquent for one mistake you made years in the past. This is your one chance to get these charges reduced or dropped so that, in the future, you can move forward with a clean slate.

Building A Defense For Your Oklahoma City Drug Offense

Hiring an experienced drug lawyer in Oklahoma City will be the key to ensuring your defense is strong when you go to trial. There are multiple strategies your lawyer can use to build your case and fight against the prosecution. For example, if you’ve been charged with drug possession, your lawyer can try to prove that the drugs weren’t yours or possibly show that you weren’t aware of the drugs being there.

Your attorney can also try to identify any errors in the police investigation of your case, which can effectively dismiss your charges. All it takes to reduce or dismiss your charges is to put reasonable doubt in the minds of the jury members.

Can I be charged with a drug crime if drugs are found in my vehicle?

You can be charged with the possession of drugs if they are found in your vehicle, but in this case, your drug lawyer in Oklahoma City will fight to prove that these drugs weren’t yours. Together, we can build a strong case in your defense and show the prosecution that you did not know about the drugs being in your possession.

Should I accept a plea bargain from the prosecution?

Depending on what the prosecution offers, plea bargaining can be a great compromise between the prosecution and the defense. Often, a plea bargain will involve a reduction in charges and penalties for your crime. It may also include getting the crime expunged from your record at a later date; however, it will mean an initial conviction.

Can a misdemeanor or felony conviction be removed from my record in Oklahoma?

The state of Oklahoma has expungement laws in place that allow both misdemeanor and nonviolent felony charges to be removed from your record after a certain period of time if you stay out of trouble. The period for misdemeanors is five years, and the period for nonviolent felonies is seven years.
