However, if a person commits the crime of possession for a second time within 10 years, the court may order the person to complete a substance abuse assessment and evaluation, as well as a diversion program for up to a year. These penalties are in addition to the sentence the court may impose.

Possession becomes a felony if a person violates the law for a fourth time within 10 years. It’s punishable by up to five years in prison and $5,000 in fines.
