The serious crime of controlled substance theft

There’s more to Oklahoma’s schedule of dangerous controlled substances apart from illicit drugs produced by the black market. The lists also include prescription medications with the potential for abuse. Medications like Adderall, OxyContin, Vicodin, Zofran, Xanax and even Robitussin A-C can be addiction-forming and cause health problems for users who abuse them.

Because these controlled substances are available as prescription medications, some people might turn to stealing to feed their addictions. Unlike illicit drugs, these prescription-based controlled substances are more readily available through medical practitioners, drug manufacturers and distributors. This makes these distributors prime targets for theft.

Pharmacies are the most common targets for controlled substance theft, with hospitals not far behind.

The theft of controlled substances is a serious crime in Oklahoma. Violators can face some of the harshest punishments of any offense.

Larceny or burglary of controlled substances

According to state law, a person who commits larceny, burglary, or theft of any controlled dangerous substance faces a charge for a felony offense. The offense is punishable by imprisonment for up to 10 years.

However, if a court convicts a person for a second or subsequent time, the punishment becomes imprisonment for not less than 10 years.

Robbery of controlled substances

Oklahoma also prohibits persons from robbing controlled dangerous substances. A violation of the law is a felony punishable by not less than five years of prison time, due to the violent nature of robbery crimes.

But if a court convicts a person of robbery of controlled dangerous substances for a second or subsequent time, a conviction leads to life imprisonment.

Individually, theft and use/possession of controlled substances are offenses that lead to severe penalties. The theft of controlled substances, unsurprisingly, leads to even greater punishments.
